§ 8.17.090. Loitering.

  • It is unlawful for any person to loiter in, about, or within 20 feet of the property line of any medical marijuana establishment with the intent to purchase, sell, solicit or distribute marijuana or drug paraphernalia, unless the person is authorized to be on the premises of the medical marijuana establishment pursuant to NRS 453A and the regulations adopted related thereto, and is acting in accordance with the provisions of NRS 453A and the regulations adopted related thereto. This intent may be evidenced by acting in a manner and under circumstances which openly demonstrate the purpose of buying, selling, soliciting, or distributing marijuana or drug paraphernalia by any person who is not exempt from state prosecution pursuant to NRS 453A.200, or in a manner not authorized by NRS 453A.
