§ 8.08.030. Soliciting, coaxing, enticing or luring children.

  • (a)

    Definitions. As used in this section:

    (1)

    "Children" means individuals under the age of 16.

    (2)

    "Communication" means verbal, non-verbal or written expression transmitted from one person to another.

    (3)

    "Course of conduct" means a pattern of conduct which consists of a series of acts over a period of time which evidences a continuity of purpose directed at a specific child.

    (4)

    "Sexual conduct" means sexual intercourse, lewd exhibition of the genitals, fellatio, cunnilingus, bestiality, anal intercourse, excretion, sado-masochistic abuse, masturbation, or the penetration of any part of a person's body or of any object manipulated or inserted by a person into the genital or anal opening of the body of another.

    (b)

    It shall be unlawful for any person to:

    (1)

    Engage in a course of conduct involving communication with, or following, a child for the purpose of committing one or more of the offenses listed below.

    (2)

    Knowingly, by any means and without privilege to do so, solicit, coax, entice or lure any child to enter into any vehicle, as defined in NRS 482.135, or structure, if both of the following apply:

    (A)

    The suspect does not have the express or implied permission of the parent, guardian or other legal custodian of the child in undertaking the activity; and

    (B)

    The suspect is not a law enforcement officer, medic, firefighter, other person who regularly provides emergency services, or social services employee and is not an employee or agent of, or a volunteer acting under the direction of, any board of education, or the suspect is any of such persons, but, at the time the suspect undertakes the activity, he is not acting within the scope of his lawful duties in that capacity.

    (3)

    Solicit, coax, entice or lure a child to engage in sexual conduct.

    (c)

    Any person convicted under this section shall be punished for a misdemeanor.
