§ 6.06.695. Speed racing and other speed violations.
(a)
A person commits the offense of speed racing or other speed violations if, on alleys, highways, roads, or streets in this city, the person drives a vehicle or participates in any manner in any of the following in which a vehicle is involved:
(1)
A race or drag race.
(2)
An acceleration contest.
(3)
An exhibition of speed.
(4)
The making of a speed record.
(b)
Definitions.
(1)
A race. For purposes of this section, racing is the use of one or more vehicles in an attempt to outgain, outdistance or prevent another vehicle from passing, to arrive to a given destination ahead of another vehicle or vehicles or to test the physical stamina or endurance of drivers over long distance driving routes.
(2)
A drag race. For purposes of this section, drag racing is the operation of two or more vehicles from a point side by side at accelerating speeds in a competitive attempt to outdistance each other, or the operation of one or more vehicles over a common selected course, from the same point to the same point for the purpose of comparing the relative speeds or power of acceleration of the vehicle or vehicle within a certain distance or time limit.
(3)
An exhibition of speed. For purposes of this section, exhibition of speed is the act of accelerating or driving a vehicle at a dangerous speed, in order to show off or make an impression on someone else.
(c)
Penalties. A violation is a misdemeanor and:
(1)
For a first offense within a three-year time period a minimum fine of $500.00;
(2)
For a second offense within a three-year time period a minimum fine of $800.00;
(3)
For a third or subsequent offense within a three-year time period a minimum fine of $1,000.00 and the court shall order the motor vehicle driver to be retested by the department of motor vehicles.
