§ 6.06.570. Overtaking a vehicle.

  • Except as otherwise provided in subsection 6.06.560(a) (vehicles not to be driven on left side of highway), the following rules shall govern the overtaking and passing of vehicles:

    (1)

    The driver of a vehicle overtaking another vehicle proceeding in the same direction shall pass to the left thereof at a safe distance and shall not again drive to the right side of the highway until safely clear of such overtaken vehicle.

    (2)

    The driver of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle upon observing the overtaking vehicle or hearing a signal. The driver of an overtaken vehicle shall not increase the speed of his vehicle until completely passed by the overtaking vehicle.

    (3)

    If vehicles on a street or highway are moving in two or more substantially continuous lines, the provisions of subsections (1) and (2) shall not be considered as prohibiting the vehicles in one such line overtaking or passing the vehicles in another such line either upon the right or left, nor shall the provisions of subsections (1) and (2) be construed to prohibit a driver overtaking and passing upon the right of another vehicle which is making or about to make a left turn.

    (4)

    The driver of an overtaking motor vehicle, when traveling under such conditions as to make it necessary to insure safe operation, shall give audible warning with his horn or other warning device before passing or attempting to pass a vehicle proceeding in the same direction.

    (5)

    The driver of a motor vehicle shall not pass another vehicle proceeding in the same direction within any intersection.

    (6)

    Meeting or overtaking school bus:

    a.

    Except as provided in subsection b, below, the driver of any vehicle upon a street, highway, alley, or premises to which the public has access, when meeting or overtaking, from either direction, any school bus, equipped with signs and signals required by the laws of the state; which has stopped on the street, highway, alley or premises to which the public has access for the purpose of receiving or discharging any pupil and is displaying a flashing red light signal visible from the front and rear, shall bring his vehicle to a stop immediately and shall not proceed past the school bus until the flashing red signal ceases operation.

    b.

    The driver of a vehicle upon the street, highway, alley, or premises to which the public has access with separate roadways, need not stop upon meeting or passing a school bus which is upon the other roadway. The driver of a vehicle need not stop upon meeting or passing a school bus when the school bus is stopped at an intersection or other place which is controlled by a traffic-control signal or at an intersection or other place where traffic is controlled by a traffic officer.

    (7)

    The driver of a vehicle shall not overtake and pass another vehicle traveling in the same direction in an area designated as a school zone or school crossing zone.
