§ 12.24.030. Conditions of reclaimed water service.

    Plan and permit requirements.

    a.

    An approved effluent management plan for the use of reclaimed water will be available for public inspection at the City of Reno Office of the City Clerk and Public Works Department, 1 East First Street, Reno, Nevada.

    (2)

    General conditions of service.

    a.

    Service may be provided for construction water and other uses permitted by law.

    b.

    Each applicant applying for reclaimed water service or a future change to service is required to complete and submit the appropriate application forms provided by the city, and to pay all required fees and charges then in effect.

    c.

    The city is not responsible for any loss or damage caused by any negligence or wrongful act of a customer or his authorized representative in installing, maintaining, operating or using any or all appliances, facilities, or equipment for which reclaimed water service is supplied.

    d.

    For the failure of the customer to comply with all or any part of this chapter, discharge permit, effluent management plan, or city requirements, the customer's service may be discontinued until the customer is in compliance. Termination of reclaimed water service shall be in accordance with section 12.24.070 of this chapter.

    e.

    All decisions of the public works director shall be final unless appealed in writing pursuant to section 12.24.080.

    f.

    The following conditions and restrictions apply to all reclaimed water service:

    (i)

    Each customer shall provide a copy of a brief, clearly worded document that describes the possible hazards and proper hygiene of working with and around treated wastewater to all affected personnel. Copies shall be included in the emergency management plan.

    (ii)

    The use of reclaimed water shall be in compliance with the approved effluent management plan and any applicable state regulations.

    g.

    A notice provided under this chapter from the city to a customer will normally be given in writing and either delivered or mailed to him at his last known address.

    h.

    Notice from the customer to the city may be given in writing at the city's operating office. The city's operating office is:

    i.

    City employees or a designated representative shall have the right of access to customer's property at all reasonable hours for any purpose related to the furnishing of reclaimed water.

    j.

    All reclaimed water service will be billed in accordance with section 12.24.040.

    k.

    No customer shall knowingly permit leaks or waste of water. Where water is wastefully or negligently used on a customer's premises, or is flowing onto adjacent properties, roads, or drainage ditches, or seriously affecting the general service or operation of the system, the city, through the director of public works or his designee, may discontinue the service if such conditions are not corrected within five days after giving the customer notice.

    l.

    A customer shall hold the city harmless from any and all legal liability or loss sustained as a result of the quality or quantity of reclaimed water provided under this chapter and provided by the city in compliance with all the terms and provisions of this chapter.
